Abstract

Buying and selling online currently does not only include buying and selling goods
for daily needs, but there are also buying and selling transactions in the form of
adding followers on Instagram social media. This study aims to identify and analyze
the mechanism of electronic transaction practice of buying and selling Instagram
social media followers based on the Civil Code and analyzing the mechanism of
electronic transaction practice of buying and selling Instagram social media
followers in Indonesia. This research is normative juridical by placing law as a
system of norms. This research was conducted using secondary data, which was
obtained through library research. the seller of followers does not fully own the
account he is selling and without the knowledge and consent of the account owner
whose account is added to the followers of people who use followers adding
services. If you look at the rules of the Civil Code in Article 1320, namely the legal
requirements of an agreement, in terms of a lawful cause. sellers of followers do
not fully own the account they are buying and selling and without the knowledge
and consent of the account owner whose account is added, other conditions there
are also many Instagram account owners who are still under the proficient category
according to the Civil Code, a certain matter is also the subject of a buying and
selling transaction to people's followers who use the services of increasing
followers. Article 26 in paragraph (1) of Law Number 11 of 2008 concerning
Electronic Information and Transactions explains that any information via
electronic media that concerns a person's personal data must be made with the
consent of the person concerned.
