Abstract
Economic development and rapid technological developments have an impact on competition tight battle requires companies to give priority to the demands of the market that requires speed and flexible response to customer demands. Respond quickly to customer demands and it's a big can determine victory and defeat in the competition. Therefore, the company recently concerned with things that speed up this process for the sake of efficiency and effectiveness of the company. One way is to give up some of the work to others via the contracted labor or service providers/laborers known as outsourcing. Since using these outsourcing companies can pay more attention to the activities of the company so the company more competitive.
But the practice of outsourcing raises issues, particularly regarding the implementation of occupational health and safety (K3) for labor. Generally, labor /outsourcing labor to get a lower salary, received minimal social security, welfare and safety are lacking, and even labor is considered as a factor of production. There are jobs, employed by a company, there are no jobs in the layoffs.
This thesis analyzes how labor/workers are treated in accordance with the status and dignity as human beings, through the implementation of occupational health and safety (K3) for labor outsourcing the terms of the Indonesian labor law, namely Law No. 23 of 2003 about Ketenagkerjaan and Law No. 1 of 1970 on Keselamatan Kerja.
The research methodology is based on data collected from library materials (secondary data) and field (primary data). Secondary data was collected through literature, by collecting written materials related to the topics covered in the form of legislation, books, research, internet, and so on. While the primary data, I get off the PT Putri Kirana. The data are the main source of the writing of this thesis, which was obtained from interviews and research.
From the results of the study authors found that the practice of outsourcing is still pose to loose for labor outsourcing, particularly in the implementation of occupational health and safety (K3) even though it is set also in the Employment Act. This is due to the mismatch of the facts on the ground with what is stipulated in the legislation.
