Those who plagiarize, hijack, and sing or reperform songs without asking
the creator for permission often don't realize their mistake, thinking they can help
popularize the song. However, this can be considered copyright infringement. The
importance of understanding the use of songs because these activities will have an
impact on the music industry, especially on songwriters. This study aims to know
and understand the juridical analysis of song covers uploaded on the youtube
platform without the permission of the songwriter about the regulation of copyright
works in Indonesia, as well as to know more about the protection and sanctions for
rights holders of copyrighted song covers for commercial purposes uploaded on the
Youtube platform. This research uses a juridical-normative type of research method,
which is to see the law in a positive legal perspective. Data were collected from
library research, readings from books, laws and regulations, scientific journals, and
internet sources, then analyzed by qualitative normative methods. The results
showed that song covers uploaded without the permission of the songwriter, singing
re-sung song copyrights or cover songs uploaded on Youtube and commercialized
and uploading without permission are acts that violate moral and economic rights.
The sanctions given are in the form of civil sanctions, namely compensation and
criminal sanctions in the form of threats of confinement and compensation.
