Abstract

Suspects as perpetrators of criminal acts are still considered as the regular
citizens who have rights regulated in various Indonesian legislations. However, in
fact, in the implementation, there are still many violations committed by police
such as cases of shootings and torture to the suspects who were caught redhanded.
The result of this research is that the procedure of arresting done by police
officers. Except in the case of being caught, everyone without any exception are
allowed to arrest the suspect in hand. Officers who are ordered to carry out the
arrest must carry a "warrant for arrest" and show the arrest warrant, except in
case of being caught by the police. However, they are supossed to bring the
arrested immediately to the investigator or adjuvant closest to the crime scene.
The last thing in the arrest is that a copy of the arrest warrant must be given to
the family of the suspect immediately after the arrest.
The protection of suspects caught by the Police in general regardless of Gender
and age can be drawn from various Indonesian laws such as the Criminal
Procedure Code (KUHAP), Indonesian Police Regulation no. 14 of 2012 on the
Management of Criminal Investigations, Regulation of the Chief of Police no. 8
of 2009 on Implementation of Principles and Standards of Human Rights in the
Implementation of Duties of the Police of the Republic of Indonesia including:
Pretrial, Getting legal aid and appointing his / her legal counsel, counseling law
authority during the process of inspection of the suspect, notifying the rights of
the suspect, having Security guarantee and Presumption of innocence. In order
to enforce and maximize the form of legal protection against suspects caught by
the Police, the Investigator needs to pay attention to the suspect's arrest
procedure in accordance with the Standard Operating Procedure (SOP) and
Indonesian legislation and to increase the understanding of the rights of suspects
so as to provide legal protection to the suspects, especially to the suspects who
were caught hand. In case the suspect caught by the Police is not aware of the
rights she/he has, the investigator must explain or clarify it to the suspect.
