Abstract
which is usually used forreligious things such as for building a mosque or Islamic boarding school. Whereas Article 16 of Act No. 41 of2004 on Waqf stated that waqf properties are not only immovable things, but also movable things. One of themovable things can be used for waqf is intellectual property rights as has been stated in Article 16 Paragraph (3)Letter e of Act No. 41 of 2004 on Waqf. That article stated that one of the properties can be used for waqf isintellectual property rights. This research aimed to discover and analyse the legitimacy of copyrights (books) royalty waqf as well as to findout and analyse copyrights (books) royalty waqf in Islamic law perspective. The methods of data presentationused the systematic and logical description as well as juridical normative approach. According to the above discussion, it can be concluded that waqf is not only in the form of giving land (used forworship place, such as mosque or school for public), but also in the form of giving intellectual property rights. Thus, the government should provide socialization to make people aware of the kind of objects can be given aswaqf. As the result, when there are some people who want to give their intellectual property rights (such as books) forwaqf, they do not have to worry about the legal status.
