Abstract

The aims of this research were to investigate and analyze the
implementation of Regional Regulation (Perda)Number 2 Year 2014 about waste
management of dangerous and poisonous materials as well as the
inhibitingfactors done by regional government (Pemda) on implementing it. This
research used Juridical Normative usinglaw system approach, particularly
lndonesian Constitution Number 32 Year 2009 about Protection andManagement
of Living Environment. This research was analytical descriptive.Based on the
research and analysis result, it can be concluded that the implementation of
Regional RegulationNumber 2 Year 2014 about Waste Management of Dangerous
and Poisonous Materials was held but it was notoptimum.conflicts that are based
on evironmental pollution from CV. Purbayasa to process waste well so as not to
pollute the environment.both liquid solid waste and gas must be lmmediately
made waste pocessing facilities. The remedies should be completed within 6 monts
of the agreement. The agreement among other the wood factory will improve the
management of waste that has the potential to pollute water or ground water has
been lmplemented but not optimal. This can be proved by, The unoptimized
implementation of law protection was due to some inhabiting factors as
mentioned inConclusion 2. The inhibiting factors faced by the regional
government (Pemda) on the implementation of thisregional regulation were the
law enforcers (SKPD) who were in charge, functions, and business on
livingenvironment focused less on law enforcement of this regional regulation.
The lack of facilities, and law enforcer(SKPD) handling living environment
especially expert was an obstacle. Society became a factor which quiteinfluence
on the law effectiveness. The awareness means positive law awareness or called
as obedience to thelaw. While negative law awareness was called as disobedience
to the law. Law awareness was an abstractconception on human thought about
the harmony between orders and tranquility as hoped. Based on culturalfactor,
law culture for society which was related to the low of internal and external law
culture.Suggestion proposed on this research is by conducting supervision,
continuous and follow up control, so that theindustry and other activities can be
monitored well relevant with the regulations applied.
