Abstract

This study aims to examine and analyze the principles of inheritance and the distribution process based on customary provisions within the Bonokeling Indigenous Community. The Bonokeling Indigenous Community adheres to a customary inheritance system that has been passed down through generations. These provisions differ from the inheritance laws in Indonesia, including Western inheritance law (BW) and Islamic inheritance law. This research employs a qualitative approach using an empirical juridical research method. The findings reveal that under the Bonokeling customary inheritance system, the testators are the parents, whether the husband (father) or the wife (mother). The heirs are the children of the testator, and the inheritance comprises a combination of the testators personal assets and marital property if the testator passes away while still married. Inheritance is distributed equally among all heirs, both male and female, based on the principle of individual entitlement. The distribution process can occur either while the testator is still alive or after their death. The Bonokeling customary inheritance provisions do not specify the exact portions allocated to each heir. Consequently, the heirs are required to reach a consensus through deliberation to determine the division of the inheritance.
