Abstract
Eight gold miners have lost their lives while mining in Pancurendang Village, Ajibarang Subdistrict. The mine is an illegal mine. The purpose of this study is to determine and analyze the legal relationship between employers and workers and the employer's responsibility for illegal gold mining workers who lose their lives in Pancurendang Village, Ajibarang District. This type of research uses empirical juridical methods, using primary data from interviews, as well as secondary data from laws and regulations and other literature, and analyzed with descriptive-analytical techniques. The results of this study show that the legal relationship between employers and workers is that there is a written agreement before starting work which stipulates “that the employer will not bear responsibility for calamities, both small and large”. The agreement is invalid and null and void, not fulfilling Article 1320 of the Civil Code and Article 1335 of the Civil Code. The employer's responsibility for illegal gold mining workers who lose their lives is that the employer has provided compensation of 200 (two hundred million) to the victim's family. This compensation is in the form of cash given to the families of workers who died as a form of assistance and attention from the employer.
