Abstract
Domestic violence cases can be resolved through litigation and non-litigation
channels. In 2023 in Banyumas Regency, 26 cases were resolved through nonlitigation
and 11 cases through litigation. The settlement through non-litigation was
carried out by involving the Regional Technical Implementation Unit for the
Protection of Women and Children (UPTD PPA). The purpose of this study is to
determine and analyze the non-litigation settlement of domestic violence and the
obstacles to the settlement of domestic violence at UPTD PPA Banyumas Regency.
This type of research uses empirical juridical method, using primary data
interviews with Siti Tarwiyah as the head of the office and Agung Riski Wisnu
Firmansyah as the head of general administration, as well as secondary data from
laws and regulations such as Law number 23 of 2004 concerning the elimination
of domestic violence, regional regulation number 1 of 2023 concerning the
implementation of the Regional Technical Implementation Unit for the Protection
of Women and Children, law number 1 of 1974 concerning marriage. and other
literature, and analyzed with descriptive-analytical techniques. The results showed
that non-litigation of domestic violence criminal acts used a settlement in the form
of mediation and counseling for handling victims of domestic violence facilitated
by UPTD PPA. Obstacles in the settlement of non-litigation of domestic violence in
the form of lack of openness of the client or victim so that the information obtained
is not optimal and the limited human resources available.
