Abstract
Contractors in Purbalingga Regency are tasked with ensuring construction
quality in line with Law Number 2 of 2017 on Construction Services and adhering
to all relevant regulations and standards. This research aims to examine and
analyze the legal responsibilities of contractors in guaranteeing the quality of
construction materials and services as per the prevailing regulations in
Purbalingga Regency. Additionally, it seeks to understand and analyze the legal
consequences for contractors in cases of non-compliance with quality standards
in construction projects within the region. The study employs a normative
juridical approach to explore pertinent legal and regulatory aspects, alongside an
empirical juridical approach involving primary data collection through interviews
and secondary data from relevant regulations and literature. The data collected is
analyzed descriptively and analytically to provide an in-depth understanding of
how contractors' legal responsibilities are implemented in practice. Findings
reveal that contractors in Purbalingga Regency are legally obligated to ensure
construction quality according to existing laws. These obligations towards service
users are outlined in Article 54, paragraph (1) of Law Number 2 of 2017 on
Construction Services, which mandates that Service Providers and/or
Subcontractors deliver work results that are accurate in terms of cost, quality, and
timing. The legal consequences for non-compliance are detailed in Article 54,
paragraph (2), which stipulates that failure to meet these standards may result in
liability for damages as agreed in the Construction Work Contract.
