Abstract
Indonesia and Malaysia were once involved in an International Dispute which was
then brought to the International Court of Justice, namely the dispute over the
islands of Sipadan and Ligitan. The dispute began in 1967 where Indonesia and
Malaysia simultaneously recognized the ownership of the islands of Sipadan and
Ligitan as one of their country's maritime boundaries. In this study the author aims
to (1) Analyze the process of resolving the Sipadan Ligitan dispute between
Indonesia and Malaysia, (2) Analyze the reasons for the MI judge to use Effective
Occupation in the process of resolving the international dispute over the Sipadan
and Ligitan Islands between Indonesia and Malaysia. This research method uses
normative juridical research type, which is research conducted by library method to
explore information related to the object of research. The results of this study: (1)
Indonesia Malaysia did not succeed in resolving the Spadan Ligitan dispute by
means of negotiations and negotiations, so that Indonesia and Malaysia agreed to
bring the dispute to MI, (2) Effective Occupation is evidenced by the presence or
absence of legal evidence in the form of legislation or legal regulations, then
Effective Occupation does not apply in areas that have been regulated by treaties,
judges' decisions or ownership of areas with clear laws. Meanwhile, Sipadan and
Ligitan Islands do not yet have clear laws and regulations.
