Abstract
This research aims to determine the mass Termination of Employment
(PHK) carried out by PT Si Fast Express during the COVID-19 pandemic, by reason
of force majeure. The main objective is to assess the suitability of layoff regulations
during a pandemic and analyze the legal implications of these actions. The method
used in this research is descriptive research method with a qualitative approach. The
informants in this study were employees at PT Sicepat Purwokerto who were
affected and not affected by the company's performance during the pandemic. The
data analysis technique used is the normative data analysis technique referring to
the theory of legal protection, justice, the welfare state, and Law no. 13 of 2003
concerning Manpower. The results of this study indicate that unilateral layoffs in
force majeure conditions have legal consequences. The results of the study confirm
the need for a balance between company interests and workers' rights during force
majeure layoffs. The resulting legal protection and economic impact on employees
must be considered. This research contributes to the understanding of legal
protection for workers and the legal implications of mass layoffs due to force
majeure in the pandemic era. Although the reasons given are valid, legal protection
for workers needs to be considered carefully.
