Abstract

Sirri marriage is a legal marriage according to religion but not legal according to marriage law. Itsbat nikah is validation of marriages that have been carried out according to Islamic religious law, but are not recorded by the Office of Religious Affairs (KUA) or the authorized Marriage Registrar (PPN). This study aims to find out the legal consequences of rejecting a marriage certificate application in the Religious Courts and what is the status of children born from marriage orders that are rejected by the religious courts. The method used in this research is Normative Juridical by using Secondary Data to provide a view of a condition and situation regarding the object of research. The results of the study show that there are legal consequences of sirri marriages and children born in marriages whose application for itsbat marriage is rejected, then sirri marriages are legally invalid.
