Abstract
The contemporary era is experiencing changing times which are increasingly
changing and leading to a modern direction resulting in an increase in the number of
people with a modernization spirit, this has penetrated women and has greatly
affected their appearance. The addition and influence of styles from various regions
both domestically and abroad make changes in individual life, especially in dress
styles. In understanding the meaning of the headscarf itself, there are differences of
opinion among commentators. Ibn Kathir said that a woman's genitals are her whole
body. Meanwhile, contemporary Mufassir M. Quraish Shihab said that a woman's
private parts are her whole body except her face and the palms of her hands. This
article will discuss the meaning of the headscarf from the perspective of M. Quraish
Shihab? And also the reason I am researching this is because I want to know why
there are so many views, especially the views of Quraish Shihab regarding the use of
the headscarf
This research is a type of library research, while the primary data source is
contained in a book by M. Quraish Shihab entitled "Muslim Women's Hijabs". As
well as internet secondary data sources, and other information that can support this
research. The research method used is the data collection method in this study is
documentation, by looking for data in the form of notes, books or other materials
related to M.Quraish Shihab's thoughts regarding the headscarf. Data analysis used by
researchers is content analysis, which is a research tool used to conclude words or
concepts that occur in a text or in a series of texts. Then with inductive analysis,
drawing a conclusion or conclusion from a concrete situation to abstract things, or
from a specific understanding to a general understanding.
Conclusions drawn According to Quraish Shihab, there is no obligation for
Muslim women to wear the headscarf. This view is based on his belief that wearing
the headscarf is not part of a religious order, because according to him, a provision
cannot be considered as shari'ah unless it is supported by clear evidence. Quraish
Shihab takes a proportional assessment approach as well as a legal causal approach
(„illat al-hukm), and applies the benefit method (istihsan bi al-'ur). He also believes
that the verses of the Qur'an regarding the limits of genitalia and headscarves, as
stated in Surah An-Nur verse 31 and Surah Al-Ahzab verse 59, do not have definite
legal clarity (not qath'i), because if something is still conjecture (zhanniy), then the
argument cannot be considered as a definite law.
