Abstract

Looking at the data on receipt of vehicle testing fees for the last three years, from 2019 to 2021 at the Banyumas Regency Transportation Service, there is a decline. Based on these data it can be seen that there are quite a lot of Mandatory Test vehicles that do not carry out periodic tests. Therefore, for legal certainty in accordance with the mandate of Law Number 22 of 2009 concerning Road Traffic and Transportation, an operation is required by carrying out raids. This study discusses the causes of the decline in the implementation of periodic tests of freight cars related to road safety at the Banyumas Regency Transportation Service and legal sanctions for violations of Law Number 22 of 2009 related to the implementation of periodic tests of goods transport cars in the Banyumas Regency area. This research uses normative juridical research methods, the approach used is a statutory approach and an analytical approach, the legal materials used are primary and secondary legal materials. The results of this study are: (1) With the existence of Covid -19, many vehicle owners do not carry out periodic tests/tests. Owners of motorized vehicles that are KBWU, Mandatory Test Motor Vehicles do not intentionally violate the provisions of not carrying out vehicle testing, but because the operational test/periodic test is very limited in terms of the number of vehicles to be tested/periodic test and the time (2) If it violates the provisions will receive legal sanctions based on article 288 paragraph 3 of Law no. 22 of 2009 namely Everyone who drives a public passenger car, bus car, freight car, trailer, and attached car which is not equipped with a periodic test certificate and a periodical test pass certificate as referred to in Article 106 paragraph 5 letter c, shall be punished with criminal imprisonment for a maximum of 2 (two) months or a fine of a maximum of Rp. 500,000.00 (five hundred thousand rupiah).
