Abstract
One form of consumer protection is the ownership of halal certification for
business actors. Arrangements related to the ownership of halal certification are
regulated in Article 1 paragraph (5) of Law Number 33 of 2014 concerning
Guarantees for Halal Products. Halal certification applies to all business actors,
including SMEs. Banyumas is one of the districts where the level of ownership of
halal certification is still low. This study aims to identify and analyze legal
arrangements regarding halal product guarantees and consumer protection
through increasing halal-certified food products in Banyumas. This research was
analyzed using normative and empirical vuridis methods with data obtained from
laws and regulations on scientific journal books as well as interviews and
questionnaires distributed to the public. The results of this study indicate that
arrangements related to the ownership of halal certification apply to all business
actors and to be able to obtain halal certification, the registration process can be
carried out through a self-declaring system for MSMEs or regular for large
businesses. The embodiment of protection that can be carried out by Banyumas
Regency through the Cooperative and UMK Manpower Office as well as nongovernmental
organizations with the status of Companion for Halal Products
(PPH) is by conducting various kinds of outreach and training. The conclusion
that can be drawn is that the regulation on the obligation to have halal
certification is still not running perfectly. This is evidenced by the fact that there
are still many business actors who do not have halal certification even though
various efforts have been made.
