According to Islamic beliefs, conducting trade is a very important act.
Buying and selling is permissible as long as it is carried out in a manner that
complies with the requirements of Islamic teachings. Business is an activity in the
field of trading to seek profit or income obtained from the results of the laborious
work that we get. An indication that a shop is legal for a brand means that the
shop has the authority to sell the brand's products and that the goods it sells are
genuine. With this in mind, deciding on a price fixing from a non-official business
actor who determines a price that is set by himself according to his own wishes is
not the same as the price that has been set by the official store.
This research uses a type of field research, the approach in this study uses
the observational method. Data collection techniques in this study were in the
form of interviews, observation, and documentation. The data analysis technique
used in this study is an inductive technique, this research focuses on existing data
in the field, data becomes very important for the authors based on the findings in
the field. The data can later answer what is the research problem, so that later it
can be classified in general.
The results of this study indicate that the practice of fixing the price of
goods below the official shop price according to Islamic law is valid and
acceptable as long as no party feels aggrieved over the occurrence of the
transaction. Positive law is based on applicable law if in reality it does not violate
legal norms then it is reasonable and when viewed from Islamic law this practice
is suitable if it meets the principles of muamalah. When comparing positive law
and Islamic law. Islamic law basically allows buying and selling before there is a
defense.
