Abstract
Agreement is a very important matter that cannot be abandoned in all
respects, including when someone will become a member of a cooperative based
on Article 1313 of' the Criminal Code. An agreement is a recht handeling which . I .
means an act which the people concerned are intended to cause legal
consequences. This study aims to determine the legal protection of members of the
savings and loan cooperative services in the mobile cashier savings service. The
research method used is a normative juridical approach using secondary data.
The results of this study indicate that the cooperative has broken promises
(default), which is not carrying out its obligations as a business actor to provide
information to cooperative members as regulated in the Financial Services
Authority Regulation Number: I / POJK / 0712013 concerning Consumer
Protection in the Financial Services Sector. . Legal protection for members of
service savings and loans cooperatives is not given enough attention based on
Law Number 8 of 1999 concerning Consumer Protection, especially the rights of
members of the Savings and Loans and Services cooperatives . . Dispute resolution
is carried out through litigation and non-litigation, against mobile cashiers who
have been decided by the Purbalingga District Court with a criminal sentence of 3
(three) years. Meanwhile, settlement of compensation to victims is carried out
through non-litigation dispute resolution, namely negotiation in accordance with
article 45 of Law Number 8 concerning Consumer Protection. Based on article
1367 of the Criminal Code, the savings and loan services cooperative provides
compensation to the victim.
