In Indonesia, there are many cases of same-sex marriage due to the falsification of
gender identity. The same-sex marriage caused by the falsification of gender identity
that the author examines is between women and women who like the same sex. Indeed,
this research aimed to identify the legal protection for women in same-sex marriage
due to the falsification of gender identity and the legal consequences of same-sex
marriage in Indonesia. The method used in this study is a normative juridical with
statutory approach and a case-based approach. The outcome of the study shows that
protection for women can be preventive and repressive, while the legal consequences
of same-sex marriage are null and void or deemed to have never existed. With this
research, the authors hope that the government and all levels of society are more
sensitive and responsive to the issues faced by women and that there will be strict
sanctions for perpetrators.
