Abstract

Indonesia and Turkey are countries with the same legal system, namely the civil
law system. Indonesia is one of the countries that strongly rejects and takes a firm
stance in prohibiting narcotics trafficking. While Turkey is one of the countries
that legalized the cultivation of marijuana and medical marijuana. The problems
studied in detail are how the prohibition of cannabis narcotics differs in Indonesia
and Turkey, and how the challenges based on the similarities between Indonesia
and Turkey in regulating the prohibition of cannabis in Indonesia. The problem is
analyzed using the statutory approach method and the comparative approach
method. The results of the analysis show that marijuana cannot be used for
medical purposes in Indonesia, and the prohibition of medical marijuana will
actually increase narcotics crime. For this reason, it is expected that the
Government will allow cannabis research that can realize the threat of
punishment is not heavier than the threat for the crimes of murder, terrorism, and
corruption, and it is expected that the authorized institutions make regulations to
allow medical cannabis with strict requirements.
