Abstract

Incidents of vigilantism (Eigenrichting) can be found in print and electronic
media, for example: pickpockets, thieves, muggers or robbers, someone is injured
because of being judged by the masses, and tragically many have lost their lives
due to the rage of the masses who carried out mass beatings together. One
example of a case of vigilante beating (Eigenrichting) that occurred in the
surrounding community is the beating that occurred in Simpur Village, Belik
District, Pemalang Regency. This study examines in depth the form of vigilante
settlement (Eigenrichting) through non-punitive mediation and also the obstacles
in the implementation of non-punitive mediation. The research was designed
using empirical method. The approach used is a case study approach (Case
Approuch), which is an approach carried out by examining related cases and also
using a statutory approach. The results achieved were that the Belik Police
conducted Restorative Justice to the reported party and the victim in accordance
with the Police Chief's regulation on Restorative Justice. The obstacles that exist
in the process of implementing non penal mediation can be seen from the
substance of law and legal structure. The benefit of implementing this noncriminal
mediation is to jointly achieve the goal of peace. So that law enforcers
are expected to uphold justice in accordance with community justice and act more
swiftly in following up community reports so as to minimize the possibility of
vigilantism and conduct socialization to the public regarding the legal
consequences of vigilantism.
