Abstract

Prior to Government Regulation Number 24 of 1997 concerning Land Registration, the management of inheritance certificates was regulated in Article 111 paragraph (1) letter c of the Regulation of the State Minister for Agrarian Affairs/Head of the National Land Agency Number 3 of 1997 concerning Implementation of Government Regulation Number 24 of 1997 concerning Registration Land. This regulation gives rise to legal pluralism with the authority of different officials/agencies in making their certificates. Heirs of foreign (Arab) descent have the right to receive legal protection in the form of the right to comfort, security and safety in the processing of inheritance certificates regarding the process of transferring land rights. The problem to be discussed in this study is how to protect the law and what are the obstacles for Indonesian citizens of foreign descent against certificates of inheritance in the process of transferring land rights at the Banyumas Land Office. This writing aims to determine legal protection and constraints for Indonesian citizens of foreign descent against the certificate of inheritance in the process of transferring land rights at the Banyumas Land Office. The method used is normative juridical, with descriptive analytical research specifications. The results of the research in this study are legal protection for Indonesian citizens of foreign descent against certificates of inheritance in the process of transferring land rights in the form of mediation with the Banyumas National Land Agency. And the obstacles in the processing of certificates of inheritance for Indonesian citizens of foreign descent in the process of transferring land rights are time and cost
