Abstract

A simple rental flat is a multi-story building that has a function as a
residence or place to live. The purpose of providing simple rental flats is regulated
in Law Number 4 of 1992, which states that "to meet the needs of decent houses,
especially for Low-Income Communities with legal certainty in their use. In this
case, the management issued the apartment tenant who did not pay without being
given the time slack as stated in the agreement and rented it back to a party who
was not from a Low-Income Community.
The writing of this thesis discusses the problem of implementing the rental
agreement for simple rental flats in Purbalingga Regency and how the legal
consequences of default by the manager of simple rental flats in Purbalingga
Regency. The research method used in this study is a normative juridical method,
namely, using a status approach.
The rental agreement for simple flats for rent in Purbalingga Regency is
legally binding. The rights and obligations of the parties have been stated in the
agreement contents, so the parties must carry out the contents of the agreement in
good faith. However, in practice, if the manager does not carry out the contents of
the agreement that is already in it properly, it can be said to be in default. The legal
consequences of default by the manager of simple rental flats are the tenant and the
manager of the simple rental flat In Purbalingga Regency. This dispute is resolved
through non-litigation involving negotiating, which both parties have agreed upon
through direct deliberation between the two parties.
