Abstract

Optimization is a process or series to find the best practices so that what is done achieves maximum results and is ideal for making the best use of existing resources. Productive waqf is a form of action from the management of waqf assets which are distinguished based on their use. However, in the welfare aspect there are problems of inequality, and there are still some obstacles in the aspect of productive waqf management such as problems in the aspects of collecting, managing, and distributing waqf results. The Ministry of Religion of Banyumas Regency itself has a lot of waqf land. The amount of land is 4,206 plots (1,528,300 M2), but the problem in Banyumas Regency is how to maximize and optimize in accordance with the mandate of the law on waqf. This is the responsibility of the Ministry of Religion of Banyumas Regency in managing the waqf. The purpose of this study was to find out how the management and constraints in optimizing productive waqf in the Ministry of Religion of Banyumas Regency were analyzed by Law no. 41 of 2004 concerning Waqf. The research method used is normative juridical. This study describes that in optimizing productive waqf, policies are made in the distribution of rewards from the surplus of productive waqf investment. The distribution is 10% for nadzir (institutional operations), 60% is for waqf purposes (maukuf 'alaih), and 30% is allocated for maintenance components (asset maintenance) and reinvestment.
