Abstract

Beheading is a crime committed on the street where the perpetrator confiscates the victim's property by using violence or threats of violence. There are many ways that the perpetrators of robberies do in order to paralyze their victims and when they carry out their actions, the perpetrators are not alone but in groups. The formulation of the problem in this study is how the crime of motorcycle robbery is viewed from the perspective of the Criminal Code (KUHP) and how the theory of legal certainty and the theory of justice are applied in the settlement of the crime of motorcycle robbery. This study uses a normative juridical method with qualitative descriptive analysis techniques. The results of the study show that 1) In the perspective of the Criminal Code, motorcycle robbery is defined as theft with violence and/or threats of violence as regulated in Article 365 of the Criminal Code, 2) The application of the theory of legal certainty in the criminal act of motorcycle robbery is reflected in the legal process that must be carried out as regulated in the Criminal Procedure Code and the application of the theory of justice still cannot be applied optimally because in reality the sentence for the perpetrator is still too short, not proportional to the consequences of the criminal act of beheading.
