Abstract

Humans are faced with basic needs namely Clothing, Food, Board. Houses are not only privately owned but there are also houses owned by the state. The house in question is a state house, where this house is intended specifically for state employees or officials as stipulated in Presidential Regulation No. 40 of 1994 concerning State Homes. This research uses the Normative Juridical approach method by describing analytically. The results of this study are (1) The authority to adjudicate the state administration court in decision No.2 / G / 2019 / PTUN.YK (2)The legal consideration of the judge in decision No.2 / G / 2019 / PTUN.YK. The results of the study are (1) the authority to adjudicate the state administration court is the absolute authority related to the authority of the state administrative court to adjudicate a case according to the object, material, or subject matter of the dispute (2) the legal considerations of the judge in the decision there are 3 aspects namely juridical, philosophical, sociological. If three aspects are fulfilled, then the justice to be achieved is realized and accounted for in judges is justice that is oriented to general justice, moral justice and society.
