Abstract

This thesis discusses the resolution of the Strong brand dispute between PT. Unilever Indonesia and Hardwood Private Limited. The beginning of the problem began with a lawsuit which was won by Hardwood Private Limited and ended with a cassation which was won by PT. Unilever Indonesia is then analyzed with the theory of legal certainty and legal protection. This research is a qualitative research with a descriptive design and using a normative juridical method. The results of the study found that trademark dispute resolution was carried out through litigation through the Central Jakarta Commercial Court and the Supreme Court. The lawsuit at the Central Jakarta Commercial Court was won by Hardwood Private Limited and stated that the Strong mark was his and the first registered mark and on appeal to the Supreme Court was won by PT. Unilever Indonesia and declares that the use of the word Strong in Pepsodent Strong 12 Jam products contains a strong meaning or adverb and does not violate the use of the brand. This, trademark registration is very important because by registering a trademark, it will get legal protection and trademark settlement does not have to go through litigation, but can be done through non-litigation channels.
