Abstract
The owner of the Exhaust Cream Pie brand had reported fake products using his brand to the DIY (Daerah Istimewa Yogyakarta) Police. After the case was handled, 180 fake exhausts from a collector in Purbalingga were seized by the police. The goods obtained were only from exhaust sales, it was not from industrial products, they did not know if the exhaust goods purchased from sales were not original goods. Exhaust collectors also sold the local Purbalingga brand, however in terms of sales, the Cream Pie brand was more in demand. This study aimed to find out and analyze what factors influence the counterfeiting of the Cream-Pie exhaust brand in Purbalingga and the dispute settlement of the Cream Pie Exhaust Brand in Purbalingga. This study used Normative and Empris juridical methods with secondary data, namely primary legal materials in the form of Law No. 20 of 2016 concerning Trademarks and Geographical Indications and Law No. 30 of 1999 concerning Abitrase. The primary data used in this study were interviews with Budibas from the Industry Office and Puguh from Apikbangga. The result of this study showed that: 1) the factors that influenced the counterfeiting of the Cream-Pie exhaust brand in Purbalingga were the demand from consumers who wanted to make an exhaust at a low price yet still seemed like a famous brand with a higher price, to gain profits quickly because the brand imitated was usually brands and goods that were in demand in the market, to avoid the risk of loss in terms of having to make a new brand famous because advertising and promotion costs were usually very large, and the difference between the profits obtained from selling goods under the counterfeit brand was much greater than the profits obtained from selling the original goods. 2) Dispute settlement of the Cream Pie exhaust brand in Purbalingga was resolved by the parties through arbitration or alternative dispute resolution resulting in compensation of Rp. 500,000,000. The suggestion of this study is that there is a need for socialization to the community and exhaust craftsmen in Purbalingga Regency about the prohibition of ordering and making fake brand exhausts.
