Abstract

Unregistered marriages have an impact on children's rights to obtain an identity for their birth, the difficulty of obtaining self-identity results in children who do not have birth certificates. The government should guarantee the basic rights of children to have their own identity. The purpose of this study was to determine and analyze the legal protection of the identity rights of children resulting from unregistered marriages and to find out the obstacles in the implementation of the granting of legal identity rights to children from unregistered marriages based on Law Number 35 of 2014 concerning Child Protection. The research method used normative juridical which is obtained from secondary data accompanied by identification and clarification of legal facts. The results of this study are legal protection of the child's identity from unregistered marriages that have been regulated in Articles 5 and 27 of the Child Protection Act. Every child has the right to get a birth certificate to follow up on these rules the government stipulates a policy of Minister of Home Affairs Regulation Number 9 of 2016 concerning Acceleration of Increasing Coverage of Birth Certificate Ownership. Barriers to providing a child's identity consist of internal factors including low public knowledge of the importance of a birth certificate, incomplete application documents for submitting a birth certificate, difficulty in paying the marriage certificate, not being able to do a DNA test because of the high cost, and the absence of a marriage certificate. to apply for a birth certificate while external factors include the database of the Population Administration Information System which is slow to access, the absence of witnesses who witnessed the marriage not being registered, the scarcity of DNA experts, and limited DNA testing equipment
