Abstract
According to the Islamic law concept concerning testaments, the term mandatory testament means a testament that must be fulfilled. In theory, a mandatory testament is an act of the ruler or judge as a state apparatus to force or provide a compulsory testament of people who have died, given to certain people under certain circumstances. Adoptive parents provide mandatory testament in the Compilation of Islamic Law provisions to their adopted children or vice versa. The writing of this thesis discusses how the views of Islamic law on the tirkah property of the kalalah heir who have adopted children and how the implementation of the mandatory will in Islamic law for adopted children given by the kalalah heir whom the heir's siblings reject. The purpose of this study is to find out how Islamic law views the tirkah property belonging to the kalalah heir who has adopted children and how the implementation of the mandatory testament in Islamic law for adopted children given by the kalalah heir whom the heir's siblings reject. The research method used in this study is the normative juridical method, namely legal research conducted through literature studies, especially secondary data such as legislation, journals, books, and supporting data such as identification and clarification of legal facts. Based on the results of research and discussion. It can be concluded that in the view of Islamic law, adopted children have the right to tirkah property belonging to the kalalah heir or adoptive parents. Adopted children have the right to receive under one of the principles in inheritance, namely mandatory will. The adoptive father gives a mandatory testament to the adopted child or vice versa. The implementation of the mandatory testament is obligatory. The mandatory choice can still be carried out even though parties refuse to carry out the will.
