Abstract
Heirs who experience mental disorders cannot take legal actions in any form that
can lead to legal consequences. Until now, the general public has often ignored
the rights of the heirs of people with mental disorders. Whereas the heirs of
people with mental disorders need to get legal protection because they cannot or
are unable to carry out legal actions in managing inheritance, legally they are legal
subjects who have the right to inherit and receive inheritance. This study uses a
normative juridical method by collecting secondary data, then analyzing the
results of research using legislation that is associated with a relevant theory. This
study describes how the management of inheritance belonging to the heirs of
people with mental disorders based on Islamic law in Indonesia and legal
protection of inheritance rights owned. Based on the results of the study, it was
stated that the heirs of people with mental disorders were not prevented from
getting inheritance, carried out with a guardianship system and had legal
protection rights.
