Abstract

In the community until now, in carrying out land buying and selling, there are still
many things that are done through buying and selling under the hands, meaning
that the sale and purchase is not carried out before a Notary / PPAT this is because
some people do not understand PPAT As in the case of a Court Decision
Purwokerto State Number: 77/Pdt.G/2020/PN.Pwt the plaintiff's father bought a
plot of land to the defendant's mother, the sale and purchase was carried out under
the hands, then, before carrying out the process of changing names and issuing
certificates, the plaintiff's father died, the plaintiff as the heirs want to transfer the
rights to the land, however, the defendant's mother also died, to achieve a legal
certainty the plaintiff and the defendant must make the transfer of land rights based
on inheritance. The purpose of this study is to find out and criticize the juridical
review of the transfer of land rights that have not been certified based on
inheritance and to know and criticize the process of resolving cases of transfer of
land rights that have not been certified based on the provisions of Law Number 5
of 1960 concerning Araria Principles and Regulations. Government Number 24 of
1997 concerning Land Registration. The purpose of this study is to find out and
criticize the juridical review of the transfer of land rights that have not been
certified based on inheritance in the decision Number: 77/Pdt.G/2020/Pn.Pwt is in
accordance with the theory of legal certainty. This research uses a normative
juridical method, carried out with a library study data collection technique, then
analyzes a research result using legislation that is tied to a relevant theory. This
research shows that in buying and selling land, it should be done before a
Notary/PPAT in order to ensure legal certainty, and have legal proof of ownership
in the form of a certificate.
