Abstract

Problems in land sectors listed in the Basic Agrarian Law Act are five, one of them is
absentee, farmland located outside the owners sub-district, land ownership. The
Basic Agrarian Law Act has mandated the prohibition of absentee farmland
ownership. Absentee land ownership can occur due to inheritance so that there are
heirs having land outside their sub-district, causing them to violate the Basic
Agrarian Law Act, whereas the ownership is their rights which must be protected.
The research aims to reveal the legal protection on absentee/guntai land ownership
obtained due to inheritance at Kantor Pertanahan in Purbalingga Regency and to
identify the legal arrangement on absentee/guntai ownership based on the laws and
regulations. The research method is normative juridical conducted through literary
study and completed with an interview. The research result indicates that the legal
protection and arrangement on the absentee/guntai land owner obtained due to
inheritance can be done through registration as in line with Government Regulation
No. 10 of 1961 and Government Regulation No. 24 of 1997 on Land Registration.
Article 53 of the Basic Agrarian Law Act explains that if the heirs do not attempt or
utilize the absentee land as it should, the legal protection can be lost. The
implemented legal arrangement has also been appropriate with the Basic Agrarian
Law Act.
