Abstract

The layoff performed by PT. Hyup Sung Indonesia to the employees and labors is
often unacceptable to them because it is not in accordance with Article 151 of Act
Number 13 Year 2003 Concerning Manpower. The problems in this research are
(a) flow is legal protection for workers in disputes over the layoff at PT. Hyup
Sung Indonesia in Purbalingga (b) How to resolve the unilateral layoff at PT.
Hyup Sung Indonesia in Purbalingga. This research uses a normative juridical
approach. This approach examines the normative juridical concept in accordance
with the prevailing laws and regulations. The results of this study are (a) Legal
protection for the employees of PT. Hyup Sung Indonesia, which is affected by
the unilateral layoff (PHK), that the dismissal of workers who are declared null
and void because based on Article 151 paragraph (3) of the Manpower Law,
employers must lay off their workers, they must first regulate the determination of
the Industrial Relations Dispute Resolution Board. (b) The Industrial Relations
Dispute Resolution Board. consists of: Bipartite, Mediation, Conciliation,
Arbitration and the Industrial Relations Court. He advice given to legal protection
for workers is to ensure that the legal rules regarding work relations are applied
consistently and the right institution for Industrial Relations Dispute Resolution to
win cases, so the right institution is indeed a litigation institution, named the
Industrial Relations Court.
