Abstract

The information and communication sector has become the most prominent sector due to the Covid-19 pandemic. E-commerce has been able to attract many consumers. However, with this development, the risk of crime will increase, so without strong coordination of various aspects of implementation and supervision of consumer protection, it will be difficult to ensure. So the authors are interested in discussing the urgency of data protection for e-commerce consumers when viewed from the ITE Law, and the platform provisions in providing e-commerce data protection against several regulations in Indonesia. The purpose of this study is to analyze the protection of e-commerce consumer data in terms of e-commerce and several regulations in Indonesia. The method used in this research is normative juridical using secondary data. The results of this study indicate that Article 26 paragraphs (1), (2), (4), and (5), Article 40 paragraphs (2a) and (2b) of the ITE Law are applied when data is stolen or in the event of improper treatment of data. or misused. However, it has not been detailed so that a derivative rule is made in Article 1 points 6, 7, and 19 of the Regulation of the Minister of Communication and Information Number 5 of 2020 regarding the organizers of private electronic systems. The provisions of e-commerce, Article 2 paragraph (1) of the Regulation of the Minister of Communication and Information Number 20 of 2016, and Article 4 of Government Regulation Number 71 of 2019 concerning the Implementation of Electronic Systems and Transactions. The consumer protection law explains the rights that must be protected, namely comfort, security, and safety as well as the right to correct, clear and honest information. With various coordination and supervision from the government, private sector, and third parties, in this case, the electronic system operator, can provide data protection for e-commerce consumers.
