Abstract

Marriage is an important event in human life, which involves both parties' personal and family, and community affairs. However, there are still many who abuse a marriage by committing adultery or having sex outside of marriage in social life. It results in a marriage fasid due to a woman's pregnancy before the marriage takes place, either with the man who impregnated her or the man who did not. This study aims to determine the legal consequences of marrying pregnant with non-biological fathers according to the Compilation of Islamic Law and prevention efforts to reduce the existence of marriages in pregnant conditions. The method used in this study is a normative juridical method with identification and clarification of legal facts as a complement to descriptive secondary data. Methods of data collection in this study using literature study and identification and clarification of legal points. The study results indicate that the legal consequences of having a pregnant marriage with a non-biological father are marriage status with a pregnant woman, which is permitted under Article 153 of the Compilation of Islamic Law. The status of a child born from a pregnant marriage is a child out of wedlock who only has a kinship relationship with his mother and his mother's family if the one who married his mother was not the man who got pregnant. Prevention efforts to reduce the existence of marriages in pregnant conditions include two stages of prevention that come from oneself or family and outside parties or related agencies.
