Abstract
A marriage that occurs between a man and a woman has the goal of creating a happy and eternal family. Although there is hope in marriage, it is possible that things can happen that can break the marital relationship, one of which is the annulment of marriage. A husband in Sumbawa Besar District filed an application for annulment of marriage against his wife because there were indications of lies about the identity of the wife's pregnancy. The husband felt cheated and thought there had been a misunderstanding against his wife, therefore he filed an annulment of the marriage to the Religious Court. The purpose of this study is to find out and analyze what things can annul a marriage and find out why the judge decided that the act of falsifying a pregnancy cannot be a reason that can cancel a marriage. This study uses a normative juridical method with data collection techniques, analysis of legislation, and literature study. This study shows that things that can annul a marriage can be broadly divided into two, namely marriages that are canceled because they do not meet material requirements such as nasabiyah, milk-siblings, and marrying wives who have been in li ‘an, while marriages can be annulled because they do not meet the formal requirements according to what regulated in the legislation. Based on case number 0689 which was decided by the judge, the Petitioner in his argument submitted a request for annulment of marriage based on Article 27 of the Marriage Law and Article 72 of the Compilation of Islamic Law. The judge stated that the argument put forward by the Petitioner was not proven because, after the testimony of the witnesses, the Petitioner's argument seemed far-fetched with the aim of escaping responsibility to the Respondent's family. Therefore, the judge decided not to grant the Petitioner's request.
