Abstract

Consumer protection is any effort that guarantees legal certainty to provide protection to consumers. Consumers' right is to get correct, clear and open information about the substance contained in the drug, including whether or not the drug contains pork. Since most of Indonesian polpulation is Muslim, halal becomes the great concerns especially on the free market drugs or the consumed drugs. The objective of this paper is to find the legal protection for consumers of free drugs sold in the market without halal labels and to find out what factors causing the number of free drugs sold in the market without halal labels. In this study, normative juridical was used as the research method. After the Halal Product Guarantee Act (UUJPH) has been legaized, the halal labeling on all products that enter, circulate and trade in the territory of Indonesia is mandatory, including drugs. However, it is only 2.5% of drugs with halal certification at the present time. This means that there are still more than 97% of medicinal products without Halal certification. Therefore, it is necessary to protect rights for consumers namely the rights of comfort, security and safety in consuming goods and / or services (letter a Article (4) UUPK) as well as the right of correct, clear and open information information regarding the conditions and guarantee of goods and / or services (letter c Article (4) UUPK). The number of drugs without halal labeling is caused by several factors, including: materials, processes, costs and timing of halal certification.
