Abstract
The large number of manpower needs in each company makes companies use 3 (three) parties or outsourcing to fulfill every field needed in the company. Outsourcing is regulated in Law Number 13 of 2003 concerning Manpower. The purpose of this research is to know the arrangement of outsourcing work agreement in Indonesia, to know the implementation and to analyze the work agreement to the Outsourcing Health, Safety, Security, And Environment (HSSE) workers at PT. Pertamina TBBM Maos, Knowing the obstacles during the implementation of the work agreement for the Outsourcing Health, Safety, Security, And Environment (HSSE) workers at PT. Pertamina TBBM Maos. The research method used in this research is a normative juridical research method, interviews with respondents and is applied using applicable laws, theories, and legal principles. In this study, it shows that the tenure of outsourcing which was previously regulated in Law Number 13 of 2003 concerning Manpower is now abolished in Law Number 11 of 2011 concerning Job Creation. Implementation of work agreements at PT. Pertamina TBBM Maos has complied with the law that regulates it because PT. TBM Maos always improves itself in the welfare of its workers. Obstacles that occur in the implementation of the agreement are the frequent changes of service/job providers so that the policy of each extension of the employment contract also changes, delays in giving salaries/wages, uncertain tenure, delays in sending duplicate agreements to workers, and changing the location of contract workers every year.
