Abstract

The purpose of this study was to determine the settlement of illegal sand mining activities in Purbalingga Regency based on Regional Regulation of Purbalingga District Number 10 of 2005 concerning Regional Mining Business Permit. The research method used is normative and sociological juridical with descriptive analytical research specifications using primary data sources and secondary data with the research location in the Environmental Service Office of Purbalingga Regency, Bukateja Sector Police, Purbalingga. Data analysis method uses descriptive analysis method.
From the results of the research carried out, it is known that the Settlement of unlicensed sand miners in Purbalingga Regency which does not have an official permit is returned to its original function as a parking lot. The regional government has received attention from the police, but the imposition of criminal sanctions is too light. In accordance with Article 158 of Law No. 4 of 2009 concerning Minerals and Coal and Regional Regulation of Purbalingga Regency Number 10 of 2005 concerning Regional Mining Business Permits, it should be more stringent sanctions provisions. Constraints in the settlement related to illegal sand mining in Purbalingga Regency is a lack of community legal awareness, lack of facilities, facilities and equipment in the eradication of illegal mining and the location of sand mining without permission that is remote and far from the city.
The advice given is the government that supervision and enforcement carried out by the police and related agencies in carrying out supervision and enforcement need to be improved, so that sand mining without permits can be put in order. In an effort to provide a deterrent impact on the perpetrators of mining crimes (illegal mining) in the District of Purbalingga, criminal and fines imposed on the perpetrators are crimes and fines that are commensurate with acts, as regulated in other laws and regulations related to mining crimes . Socialization related to sand mining needs to be carried out by related parties such as the Regional Government and the Office of the Environment and to provide legal awareness to the community so that illegal sand mining can be minimized. Adding the facilities and facilities needed is an important thing to do. It is necessary to increase road access to the mining site.
