Abstract

In practice, there is often double certificate in society so the land rights holder needs to find information about the truth of physical and juridical data of the related land in the local National Land Agency. Commonly the issue of double certificates (overlapping) in which the land has more than one certificate that the land location is overlapping, happens when the certificate holder is about to carry out legal action against the concerned land. This research aimed to find out and to criticize the process of land dispute that is indicated overlapping through alternative dispute resolution by the National Land Agency of Brebes and to criticize the obstacles faced by National Land Agency regarding this issue. The approach methods used in this research were normative juridical, descriptive research specification with the research location in the area of Land Agency Office of Brebes Regency. The data of this research were primary, secondary, and tertiary. The data analysis method was descriptive which included explaining, elaborating, and describing based on the problem. The results showed there was a case where the certificate rights in the name of Fth with the certificate rights in the name of Msh was located in the village of Luwung Bata, Tanjung district. The effort done by National Land Agency to solve this dispute was by mediation. Meanwhile, the obstacle of this issue was that both of the stakeholders did not want to lose or give in. It was expected for the stakeholders to follow the suggestions and advices from the National Land Agency as the mediator. Socialization to society was also needed to introduce the importance of peaceful settlement of land dispute through mediation in National Land Agency.
