Abstract

This essay explains the juridical review of defamation via electronic media of short message service (SMS) in ABSTRACT Purbalingga Regency on the decision No. 148 /Pid.sus/2016/PN Pbg. This research aimed to find out the elements and analyze the criminal act of defamation and to find out and analyze the judge's legal. This research used normative juridical with analytical description. The result of this research was the decision of Purbalingga District Court No. 148 /Pid.sus/2016/PN Pbg. The conclusions of this research were: 1. The elements of criminal act of defamation as stated in Law No. 11 Year 2008 that was fulfilled on the Electronic Transaction and Information had been fulfilled in the Decision No. 148 /Pid.sus/2016/PN Pbg. 2. The judge's legal consideration in the Decision No. 148 /Pid.sus/2016/PN Pbg included the entire elements of defamation as stated in Article 27 Verse 3 and Article 45 Verse (1) of Law No. 11 Year 2008 were fulfilled, however the panel of judges had no consideration for the decision explaining that the defendant had apologized to the victim and the victim had forgiven the defendant and not legally prosecuted or revoked the case.
