Abstract

The permission to establish public transportation businesses could only be given to business entities, not individuals. Travel agencies with private vehicle causes the lack of legal certainty and consumer protection for the users. This research was aimed to analyze the responsibility of drivers and travel agency with private vehicles if they caused loss to the rights of passengers; and to find out the legal effort of the passengers for the loss caused by drivers and entrepreneurs of travel agency with private vehicles. The method of the research used was normative juridical with descriptive analysis design. The data sources were primary and secondary. The location of the research was in UMP (Universitas Muhammadiyah Purwokerto) and transportation office of Banyumas regency. The data were then analyzed by using descriptive analysis. The results showed that the responsibility of drivers and travel agency with private vehicle entrepreneurs according to article 19 of the law number 8 year 1999 about consumer protection in relation to article 240 of the law number 22 year 2009 about road traffic covering responsibility based on fault, responsibility based on presumption, and absolute responsibility. The legal efforts which that could be taken for the loss experienced by the passengers of travel agency with private vehicles, based on article 45 paragraph 2 of the law number 8 year 1999 about consumer protection, were through litigation and non-litigation based on the choice of the parties in dispute. Through litigation process, the dispute was tried to be solved peacefully. If the dispute could not be solved peacefully, the dispute was then brought to Consumer Dispute Resolution Board (BPSK). However, if the solution still could not be reached, the parties could appeal to the district court, high court, and Supreme Court. The implication of this research was that government and law enforcement apparatus should be thorough and firm especially when doing law enforcement on the entrepreneurs of travel agency with private vehicle. Moreover, the passengers should also notice vehicle number in order to track the driver and to solve the problem peacefully or legally.
